Terms and Conditions on Usage of Open Source Designs
LAST REVISED: April 2025 These terms and conditions (the "Terms") apply to your use of open source projects that are made availalble for public access and are licensed under the Creative Commons Attribution-NonCommercial (CC BY-NC-SA) license (the "Projects"). By accessing or using the Projects, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Projects.1. Scope of License
The Projects are licensed under the CC BY-NC-SA license, which allows you to use, modify, and distribute the Projects for non-commercial purposes, as long as you give appropriate credit to the original creators of the Projects and indicate if any changes were made. 2. Disclaimer of Warranties
The Projects are provided on an "as is" and "as available" basis. You understand and agree that your use of the Projects is at your own risk, and that the Projects are provided without any warranties of any kind, either express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
3. Limitation of Liability

You agree to indemnify and hold Northwest Engineering Solutions, its staff, employees, contractors, vendors, and other suppliers harmless from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to attorneys' fees, resulting directly or indirectly from a claim by a third party that arises in connection with your use of the Projects.
5. Termination
These Terms will remain in effect as long as you use the Projects. The creators of the Projects reserve the right to terminate your access to the Projects at any time and without notice, for any reason, including, but not limited to, your breach of these Terms.
6. Governing Law
These Terms and your use of the Projects will be governed by and construed in accordance with the laws of the State of Oregon, United States of America, without giving effect to any principles of conflicts of law.
7. Entire Agreement
These Terms constitute the entire agreement between you and the creators of the Projects, and supersede all prior or contemporaneous communications and proposals, whether oral or written. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
8. Changes to These Terms
The creators of the Projects reserve the right to make changes to these Terms at any time and without notice. Your continued use of the Projects after any such changes constitutes your acceptance of the new Terms.
